Doctors, pharmacists, nurses: easily share medication reviews
When assisting patients to take their medication, nurses must check that the pill dispenser conforms to the prescription. What are the nurse's obligations when the pill dispenser is prepared by the pharmacist with full traceability?
The regulatory answer is very clear. The self-employed nurse who uses the MEDIPAC pill dispenser prepared by the pharmacy for total traceability has a dual responsibility: a documentary verification obligation (the right patient, at the right time) and a technical verification obligation.
Before using the pillbox for the veryfirst time, the first step is to check the traceability documents: the patient's identity, the pharmacist's identity, the presence of the correct prescription (scan), etc. By scanning the QR code on the pillbox, the nurse can access all this information via the Medissimo Infirmière application, and verify its accuracy. He will then validate that the pillbox is indeed that of the person concerned, that the pharmacist's name is correct, that the prescription is indeed present, that it is the one that applies to the patient at the time, and that the dosage schedule corresponds. This documentary check meets a performance obligation: the liberal nurse ensures that the documentation is present and that the information is consistent. At this stage, any gaps or anomalies (defects, inconsistencies, inaccuracies) must be detected. He also checks that the pill dispenser is properly sealed and that no compartments have been opened.
The second obligation concerns the contents of the pillbox. The nurse must carry out a visual quantitative check: the number of capsules or tablets corresponds to what is specified on the prescription. In other words, there are 3 capsules in the morning, 2 at bedtime...
They must also carry out a qualitative visual check: using their Medissimo Infirmière application, they click on the blisters and facially check for the presence of a scored tablet, a blue diamond, a capsule, and so on. While it's obvious that the nurse can't directly check the identity of the molecule in the blister pack, he or she should spot any obvious errors in numbers or shapes, and ask the pharmacist if in doubt. If no obvious non-conformity is detected at this stage, the pharmacist is liable for any error in the active ingredient. The Medissimo Infirmière application is there to record proof that the check has been carried out.
Clearly, once the IDEL has validated his or her check, it is the pharmacist who is liable in the event of a proven medication error. The law is very clear on the subject, as attested by the legal consultation carried out by Francis Megerlin, professor of health law at Strasbourg University.
